1. Acceptance of Terms

By creating an account or using WinBidIQ AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

WinBidIQ AI is a subscription-based SaaS platform that provides AI-powered government tender discovery, matching, and proposal drafting tools for businesses. The Service aggregates publicly available tender data from sources including SAM.gov and TED EU.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old and have legal authority to bind your company.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations.
• Attempt to reverse-engineer, scrape, or copy the platform's AI models or data.
• Use automated tools to abuse the proposal generation feature beyond reasonable use.
• Share your account credentials with third parties.
• Submit false, misleading, or fraudulent company information.

5. Subscriptions & Billing

Paid plans are billed monthly or annually. Prices are listed on our pricing page. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months except where required by law.

6. AI-Generated Content

Proposals and match scores generated by WinBidIQ AI are provided as drafts and decision-support tools only. They do not constitute legal, financial, or procurement advice. You are solely responsible for reviewing, editing, and submitting any proposal to a contracting authority. WinBidIQ AI makes no guarantee regarding the accuracy of match scores or the success of any bid.

7. Intellectual Property

The WinBidIQ AI platform, its design, code, and branding are owned by WinBidIQ AI. Content you create using the Service (proposals, profile data) remains yours. You grant us a limited license to process your data to provide the Service.

8. Limitation of Liability

To the maximum extent permitted by law, WinBidIQ AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost contracts, lost revenue, or data loss. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from your account settings.

10. Governing Law

These Terms are governed by applicable law. Disputes will be resolved through binding arbitration or the courts of the jurisdiction in which WinBidIQ AI is registered.
